By accessing or using Alchemic-Arts.com ("the Website") or its associated software application ("Application"), you agree to the terms of this Agreement. If you do not agree, you must not use the Website, Application, or Services.
By creating an account, checking the acceptance box during registration, or using the Services, you confirm that you understand and accept these terms and the Privacy Policy. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these terms.
A valid email address is required to create an account. New accounts begin with an unverified email address until the verification process is completed. You are responsible for maintaining accurate account information, protecting your credentials, and promptly notifying Us of suspected unauthorized access.
Usernames must comply with the format and availability rules shown during registration and in account settings. Usernames are unique without regard to letter case, and username changes may be limited in frequency.
The Services are intended for a general audience and are not directed to children under 13. You must be at least 13 years old to create or use an account. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these terms on your behalf.
You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.
Our collection, use, retention, and disclosure of personal information are described in the Privacy Policy. Features that you deliberately use to share custom content with friends or groups are user-directed disclosures and are not promises that the content will remain known only to you. Group members may be able to view shared content while access remains enabled.
No security or access-control system can guarantee absolute confidentiality. Do not submit information that you are not authorized or prepared to store through the Services.
You retain any rights you already hold in character data, custom game content, descriptions, notes, and other material you submit (collectively, "User Content"). You do not acquire ownership of third-party material merely by entering, adapting, or sharing it through the Services.
You grant Alchemic Arts LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, transmit, and otherwise process your User Content only as reasonably necessary to operate, secure, maintain, and improve the Services and to provide the sharing choices you select. This license permits Us to make shared custom content available to the friends and group members you authorize. It ends when the User Content is deleted from active systems, except to the extent it remains temporarily in backups, logs, or records retained for security, legal, or operational purposes.
You represent that you own your User Content or have all permissions necessary to submit and share it through the Services. You are responsible for the legality, accuracy, and contents of your User Content and for selecting appropriate group-sharing settings.
Access controls, small audiences, private libraries, and group-only sharing do not authorize copying or sharing material that would otherwise violate copyright, trademark, privacy, publicity, confidentiality, or other rights.
Custom content may be shared on a read-only basis with members of groups for which the relevant sharing option is enabled. Shared content is referenced from its creator's library rather than transferred into the recipient's ownership. Group membership, permissions, and sharing settings may change. When access is revoked, affected shared content may stop appearing in searches and may be removed from character sheets that referenced it.
You should keep your own backup of important User Content. We do not guarantee that shared content will remain available, that a group will continue to exist, or that another user will continue sharing particular content.
Alchemic Arts does not pre-screen every private or group-shared custom-content entry. We may review, restrict, disable, or remove User Content when We reasonably believe it violates these terms, applicable law, or another person's rights.
A rights holder or authorized representative may report a copyright concern to Feedback@Alchemic-Arts.com. A report should identify the protected work, identify the material at issue with enough information for Us to locate it, provide the reporting party's contact information and authority to act, and explain why the use is believed to be unauthorized. We may request additional information and may notify the affected user. This contact provision does not represent that Alchemic Arts has registered a designated agent under 17 U.S.C. § 512.
To the extent permitted by law, you agree to indemnify and hold harmless Alchemic Arts LLC from third-party claims, losses, and reasonable costs arising from your User Content, your infringement of another person's rights, your unlawful use of the Services, or your material violation of these terms.
To the extent permitted by law, the Services are provided "as is" and "as available" without warranties of uninterrupted availability, error-free operation, content availability, or fitness for a particular purpose. Alchemic Arts LLC is not liable for loss of User Content, changes in access to shared content, actions taken by group owners or editors, unauthorized access outside Our reasonable control, or reliance on user-created game content. Nothing in these terms excludes liability that cannot lawfully be excluded.
We use technical and organizational safeguards intended to protect accounts and content, including authentication and user-based access controls. You must not test, probe, bypass, or interfere with those safeguards without Our written authorization. No safeguard eliminates all risk.
We may add, modify, suspend, or discontinue features. When reasonably practical, We will provide notice of material changes through the Website, account notifications, or email.
The Services may contain advertising and links to websites, products, or services operated by third parties. Advertising may be selected, delivered, and measured by third-party providers, including Google AdSense if enabled. Third-party services are governed by their own terms and privacy practices, and Alchemic Arts LLC does not control or endorse every advertisement, destination, product, or service they provide. Your interactions with third parties are between you and the applicable third party.
Advertising will not change your ownership of User Content. We may determine which otherwise eligible pages or portions of the Services display advertising and may offer an ad-free experience to eligible supporters. You may request account deletion at any time.
We may restrict content, suspend access, or terminate an account for violations of these terms, infringement of third-party rights, abuse, fraud, security risks, legal requirements, or conduct that threatens other users or the Services. Where appropriate, repeated infringement or repeated credible infringement complaints may result in account termination.
This Agreement is governed by the laws of the State of Michigan and applicable United States federal law, without regard to conflict-of-law principles. Nothing in this section deprives a consumer of protections that cannot lawfully be waived under the law applicable to that consumer.
These terms, together with the Privacy Policy and any additional terms presented for a particular feature, constitute the entire agreement between you and Alchemic Arts LLC concerning the Services and supersede prior discussions or understandings concerning them.
If a provision of these terms is found unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of the right to enforce it later. You may not assign or transfer your rights or obligations under these terms without Our consent. We may assign these terms in connection with a merger, acquisition, reorganization, sale of assets, or operation of the Services by a successor.

We may update this Agreement periodically. The updated version will identify its effective date. When reasonably practical, material changes will be communicated through the Website, account notifications, or email. Your continued use of the Services after an updated version takes effect constitutes acceptance of the updated terms.
