Terms of Service and End User License Agreement

By accessing or using Alchemic-Arts.com ("the Website") or its associated software application ("Application"), you agree to the terms of this Agreement. If you do not agree, you must not use the Website, Application, or Services.

1. Acceptance of Terms

By creating an account or using the Services, you confirm that you understand and accept these terms, including any modifications described in Section 12.

2. User Accounts and Eligibility

2.1 Account Creation

A valid email address is required to create an account. Username choice is unrestricted, but spamming or inappropriate behavior is prohibited.

2.2 Eligibility

The Services are intended for all ages. Users under 13 must have parental consent.

2.3 Prohibited Activities

• Spamming or abusing user feedback tools
• Attempting to hack or compromise the system
• Using slurs or profanity in character names (other character data may contain profanity but it is discouraged)

3. License Grant

3.1 Scope

You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.

3.2 Restrictions

• Do not share or distribute the Application without authorization.
• Do not reverse engineer or extract source code.
• Do not use the Services for unlawful or harmful activities.

4. Privacy and Data Usage

4.1 Data Collected

• Account information (email, first name, last name, age)
• Character sheet data
• Device type
• Engagement data via Google Analytics and AdSense

4.2 How Data Is Used

• Providing and improving Services
• Developing features such as random character generation

4.3 Third-Party Sharing

Engagement data is shared with Google AdSense and Google Analytics only.

4.4 User Rights

Users may export or delete their account and data at any time. Deletion requests may require up to 30 days.

5. User Content and Generative Features

5.1 Ownership

You retain ownership of your character data. You grant Us permission to use anonymized data for generative features.

5.2 Prohibited Content

• Content that violates intellectual property rights
• Illegal, offensive, or defamatory material

6. Indemnity and Limitation of Liability

6.1 Indemnity

You agree to indemnify Alchemic Arts LLC for damages arising from unauthorized use or security issues caused by your actions.

6.2 Liability Disclaimer

We are not responsible for data loss, unauthorized access, or damages related to the use of the Services.

7. Security Measures

• Password hashing and salting
• SQL injection prevention
• User ID–based access controls

8. Modification of Services

We may modify or discontinue Services without prior notice. Significant changes will be communicated via email.

9. Termination of Use

9.1 Voluntary Termination

You may request account deletion at any time.

9.2 Involuntary Termination

We may terminate your account for violations or security risks.

10. Governing Law

This Agreement is governed by United States and Michigan state law.
